- Former Nairobi Provincial Commissioner Davis Nathan Chelogoi has been jailed over a disputed Lower Kabete property.
- The court rejected his claim that the land was allocated to him by former President Daniel arap Moi.
- A former senior Lands official charged alongside him was acquitted.
Former Nairobi Provincial Commissioner (PC) Davis Nathan Chelogoi has been sentenced to three years in prison following his conviction in a Ksh1.3 billion land fraud case involving a disputed property in Lower Kabete, Nairobi.
Milimani Chief Magistrate Dolphina Alego handed down the sentence on Monday, November 2, 2026, after finding Chelogoi guilty on five counts in a case involving a 7.39-hectare parcel of land valued at approximately Ksh1.35 billion.
The court directed that the sentences run concurrently, meaning the former provincial administrator will serve a total of three years behind bars. No fine was imposed as an alternative to the custodial sentence.
The case centred on allegations that Chelogoi was involved in the fraudulent acquisition and subsequent registration of the prime property, which two businessmen, Ashok Rupshi Shah and Hitenkumar Amritlal Raja, claimed to have legally purchased from Liney Company Limited in January 2007 for Ksh33 million.
During the proceedings, the prosecution presented evidence from 19 witnesses, including land officials, surveyors and document experts, challenging the authenticity of documents used to support Chelogoi’s ownership claim.
Chelogoi had maintained that he acquired the property through an allocation by former President Daniel arap Moi in 1995, arguing that his demanding responsibilities in public service delayed the completion of the ownership documentation.

However, the court found that he had failed to produce credible records establishing the alleged allocation or demonstrating a legitimate history of ownership.
The prosecution also presented evidence questioning the authenticity of signatures and official stamps appearing on documents submitted in support of his claim.
In his defence during Monday’s sentencing, Chelogoi’s lawyer appealed for leniency, urging the court to consider a non-custodial sentence on account of his client’s advanced age and deteriorating health.
The defence further argued that Chelogoi had cooperated with the court throughout the trial and had not interfered with the complainants or attempted to obstruct the judicial process.
The sentencing marks a major development in the prolonged legal battle over the lucrative Lower Kabete property, which has been the subject of several court proceedings.
Chelogoi previously served as Nairobi Provincial Commissioner during the administration of former President Moi.
His co-accused, former Assistant Deputy Director of Lands Administration Andrew Aseri Kirungu, was acquitted after the court found that the prosecution had not sufficiently established his involvement in the alleged criminal dealings.
